The fine print, in plain words

Short-term
rental agreement

This is the agreement you accept when you book. The dates, the total and every amount referred to below are the ones shown on your booking confirmation. Nothing here replaces the house rules — they are part of this agreement too.

Plain English, on purpose. If anything below is unclear, ask before you pay. We would rather answer a question than argue after the fact.

1. Who this is between

This agreement is between the owner of Legacy Gathering Estate in McCool, Mississippi (“the owner”) and the person who makes the booking (“the guest”).

The guest who books is responsible for everyone in the party — every person who stays, visits or comes onto the property during the booking, including children. The guest who books must be at least 25 years old and must stay at the property for the whole booking.

2. What is being rented

The entire home and the guest-use areas of the grounds, for the dates on the confirmation. Locked owner, maintenance and supply closets are not included and are not to be opened.

Check-in is after 4:00 PM and checkout is before 11:00 AM. Access instructions are sent before arrival and are not to be shared outside the booked party.

3. How many people

Occupancy is capped at twenty-six people. Everyone staying must be named on the booking. Day visitors and any event involving people who are not staying over must be disclosed and approved in writing before booking, and may carry an additional fee.

Exceeding the cap, or bringing undisclosed visitors, is a breach of this agreement. The owner may end the stay immediately with no refund.

4. Payment

Payment is taken on the schedule shown on the booking confirmation. The dates are reserved only once the first payment clears, and the booking is not confirmed before then. If a scheduled payment is missed and is not resolved within three days of a reminder, the owner may cancel the booking and release the dates, and the cancellation terms below apply.

5. Cancellation

The terms on the house rules page apply, and are repeated on your confirmation. If the owner has to cancel for a reason within the owner's control, the guest receives a full refund of everything paid. That is the limit of the owner's liability for a cancellation; the owner is not responsible for travel, catering or other costs the guest has committed to elsewhere.

6. Damage, and the deposit

A refundable damage deposit is held as stated on your confirmation. It is not charged unless it is needed, and it is released after the house has been checked following checkout.

The guest is responsible for loss or damage caused by anyone in the party, including amounts beyond the deposit. Ordinary wear is expected and is not charged for. Damage means breakage, staining, missing items, smoking indoors, and the cost of repair or replacement.

The guest agrees to report damage before checkout rather than leaving it to be found.

7. The pond, the grounds, and risk

The pond is for fishing only. No swimming, no boats, no rafts or floats. There is no lifeguard, no fence and no shallow end.

Children must be supervised by an adult at all times near the pond and anywhere on the grounds.

The guest and everyone in the party use the house, the pond and the grounds at their own risk, and accept responsibility for their own safety and that of their children and guests. Nothing in this clause limits any liability that cannot be limited by Mississippi law, including liability for death or personal injury caused by the owner's own negligence.

8. Events

Events involving people who are not staying overnight require written approval in advance and carry an additional fee. For approved events the owner may require a certificate of event liability insurance naming the owner as an additional insured, a larger damage deposit, a final headcount in advance, and an agreed end time.

Holding an unapproved event ends the stay with no refund, and the event fee remains payable.

9. Pets

Pets are welcome when declared at booking, and a pet fee applies. Pets are not to be left alone in the house or allowed on beds and furniture. The guest is responsible for any damage, additional cleaning or odor treatment caused by an animal.

10. Smoking

No smoking or vaping anywhere inside the house. Smoking is permitted outside, away from the building, with butts disposed of properly. Evidence of indoor smoking is charged for deep cleaning as set out in the house rules.

11. Cameras and privacy

There are exterior security cameras covering outdoor approaches and parking. There are no cameras inside the house, and none in any bedroom or bathroom. Disabling or obstructing the exterior cameras is a breach of this agreement.

12. Things that end a stay early

Without refund: exceeding twenty-six people, an unapproved event, smoking indoors, swimming in the pond, illegal activity, or conduct that endangers the property or anyone on it. The guest and the party agree to leave promptly if the owner ends the stay on these grounds.

13. Taxes

Mississippi charges state sales tax on short-term lodging, applied to the nightly rate and the cleaning fee, plus any local tax that applies to this address. Tax is shown as a separate line on your confirmation.

14. If something breaks

The owner will put right any failure of the house's systems as quickly as is reasonable. The owner is not liable for interruptions outside the owner's control, such as loss of power, water or internet service from the utility, or for weather.

15. Governing law

This agreement is governed by the law of the State of Mississippi.

16. Accepting this agreement

Ticking the box on the booking form, or paying the first installment, means the guest has read and accepted this agreement and the house rules, on behalf of everyone in the party.
